A total of 458,566 trademarks were filed with the U.S. Patent and Trademark Office in 2018. That figure comes from a search of the Trademark Electronic Search System (TESS) conducted on January 8, 2019.
It was quite a year for the filing of trademark applications, but how does it compare to prior years?
In 2017, 450,486 federal trademark applications were filed. The year prior to that, 400,974 trademark applications were submitted to the U.S. Patent and Trademark Office.
That means that there is absolutely an upward trend in trademark applications, and we are happy to support a portion of those who have filed applications in the recent past.
Why are so many people and companies interested in filing trademark applications with the U.S. Patent and Trademark Office? The American Bar Association reveals a few important benefits: (i) it grants the right to use the registered trademark symbol: ®, (ii) it grants the right to file a trademark infringement lawsuit in federal court and to obtain monetary remedies, including infringer’s profits, damages, costs, and, in some cases, treble damages and attorneys’ fees, (iii) it acts as a bar to the registration of another confusingly similar mark, and (iv) it may serve as the basis for an international trademark application.
